Please read these terms and conditions of use (the «Terms») of Clinique Omicron carefully.
Clinique Omicron operates this website, including all of its pages, subdomains, electronic forms, digital tools, appointment scheduling interfaces, virtual service platforms, and social media pages and accounts (collectively, the «Site»).
These Terms and Conditions set forth the terms and conditions under which you may access, view and use the Site and all material presented or made available on the Site, including, without limitation, text, general information, medical content of an informative nature, images, videos, forms, questionnaires, interfaces, software and all other digital elements (the «Content»).
By accessing or using the Site, the user, understood as any individual or legal entity who browses, consults or uses the Site in any manner whatsoever (the ’User«), agrees to be bound by all of these Terms, as well as the Privacy Policy, the Terms of Sale, if applicable, and any other policy or legal notice published by Clinique Omicron and incorporated by reference (collectively, the »Legal Notices«).
The terms «you» and «your» refer to the User.
These Terms are legally binding on the User and Clinique Omicron. By accessing, browsing or using the Site or any of its content, forms, features or digital services, you acknowledge that you have read, understood and agree to be legally bound by these Terms, regardless of whether you create an account, book an appointment or use medical services.
If you do not agree to these Terms, you must not access or use the Site.
Clinique Omicron reserves the right to modify these Terms at any time by updating this posting. Your continued use of the Site following the posting of changes constitutes your express acceptance of the Terms as modified. You are responsible for regularly reviewing this section for any updates.
By using the Site, you represent and warrant that you have the legal capacity to accept and be bound by these Terms. When you use the Site on behalf of a third party, a minor or a dependent, you declare that you are legally authorized to do so and that you accept responsibility in this respect.
Clinique Omicron is a clinic that offers face-to-face medical care on its premises, through health professionals duly authorized to practice in accordance with the laws and regulations applicable in Quebec. The Site is a complementary tool to these clinical activities and is intended to provide general information, facilitate certain administrative procedures and, where applicable, provide access to digital or virtual services offered by the Clinic.
The Site is in no way intended to replace an in-person medical consultation, clinical examination, diagnosis, treatment or follow-up by a healthcare professional, except where the Clinique expressly offers a remote medical consultation service (telemedicine or teleconsultation) within a structured framework that complies with applicable laws and professional standards. Unless expressly indicated, the information and Content provided on the Site are of a general nature and should not be construed as personalized medical advice or clinical management.
Clinique Omicron offers various types of services, including face-to-face care, teleconsultation services when expressly offered, and administrative or digital services accessible via the Site. Each service is governed by its own terms, conditions and professional requirements. Access to or use of the Site does not guarantee the eligibility, availability or obtainment of any particular service.
Clinique Omicron endeavors to provide continuous access to the Site. However, access to the Site, all or part of its Content, functionalities or digital services may be suspended, limited or interrupted, temporarily or permanently, without notice, in particular for reasons of maintenance, updates, patches, security, technical failures, operational constraints, problems related to telecommunication networks, third-party service providers or any event beyond the Clinique's reasonable control.
Clinique Omicron does not warrant that the Site will be uninterrupted, error-free, secure or available at all times. The Site may be subject to delays, interruptions, bugs, data loss or malfunctions inherent in the use of the Internet and digital technologies.
Access to the Site and some of its functionalities may depend on the type of device used, the browser, the operating system, the technical configuration of the User or the quality of his/her Internet connection. Clinique Omicron does not guarantee compatibility of the Site with all devices, browsers or configurations.
To the fullest extent permitted by law, Clinique Omicron disclaims all liability for any direct or indirect loss, damage or inconvenience resulting from the unavailability of the Site, inability to access the Site, interruption of service, technical malfunction or use of or reliance on the Site or its Content.
The User undertakes to use the Site responsibly, lawfully, ethically and in compliance with these Terms, applicable laws and regulations, and the rights of Clinique Omicron and any third party.
It is strictly forbidden to use the Site in a way that could undermine its operation, security, integrity or availability, in particular by attempting to disrupt access, compromise systems or divert normal use.
Without limiting the foregoing, the User agrees not to:
- use the Site for illegal, fraudulent, abusive or misleading purposes; ;
- infringe the intellectual property rights of Clinique Omicron or third parties; ;
- transmit, upload or disseminate viruses, malware, harmful code or any other material that may damage the Site or computer systems; ;
- attempt to gain unauthorized access to any system, server, database or information related to the Site; ;
- use robots, scripts, automated tools or similar processes to extract, copy, monitor or exploit Site Content; ;
- disseminate content that is defamatory, offensive, hateful, discriminatory, obscene or contrary to public order; ;
- collect, use or disclose personal information about others without lawful authority or valid consent.
The User remains solely responsible for any use of the Site made under his or her control, including any information transmitted, any request submitted and any action taken through his or her intermediary.
Clinique Omicron reserves the right, at its sole discretion and without prior notice, to restrict, suspend or terminate access to the Site or certain of its functionalities if it considers that any use contravenes these Conditions, applicable laws or the security and proper functioning of the Site, without it being liable in any way in this respect.
The Site and the digital services offered by Clinique Omicron must under no circumstances be used for medical emergencies. In the event of an emergency or medical condition likely to endanger the life or integrity of a person, the User must immediately contact the emergency services by dialling 911 or go to the nearest emergency service.
Without limiting the foregoing, the following situations, including but not limited to, constitute medical emergencies and cannot be handled through the Site or digital services:
- chest pain ;
- breathing difficulties ;
- loss of consciousness or altered state of consciousness ;
- symptoms suggestive of a stroke (paralysis, speech impairment, sudden confusion, etc.); ;
- severe abdominal pain ;
- fever in a child under twelve (12) months of age ;
- any serious, acute or progressive medical condition requiring immediate in-person assessment.
The User acknowledges and accepts that Clinique Omicron, its healthcare professionals and representatives cannot be held liable for any consequences resulting from a User delaying, avoiding or substituting an emergency consultation or appropriate medical care through the use of the Site, its Content or digital services.
No information, indication or functionality accessible on the Site should be interpreted as an authorization, recommendation or alternative to emergency care.
Except where Clinique Omicron expressly offers a face-to-face or remote medical consultation service within a structured and supervised framework, the Content accessible on the Site is provided for general information purposes and in no way constitutes medical advice, a diagnosis, a treatment, a clinical recommendation or personalized medical care.
Consulting, using or browsing the Site, including accessing health information, educational content, forms, questionnaires or digital tools, does not in itself create a patient-healthcare professional relationship, clinical relationship or therapeutic relationship between the User and Clinique Omicron or any of its professionals.
A clinical or patient-healthcare professional relationship is deemed to exist only when :
- one of the Clinic's healthcare professionals expressly agrees to take charge of the User; ;
- a clinical procedure is undertaken within a framework that complies with the law, professional standards and the clinic's internal policies; ;
- and, where applicable, the required consent is obtained.
The User acknowledges that it should never ignore, delay or substitute appropriate in-person or remote medical consultation based solely on the Site Content. Any decision regarding the User's health should be made in direct consultation with a qualified health care professional.
Clinique Omicron does not warrant that the Content of the Site is complete, current or applicable to the User's particular circumstances, and disclaims all liability for the use or interpretation of the Content outside of a formal clinical setting.
Where expressly indicated on the Site, Clinique Omicron may offer virtual and telemedicine services, including remote medical consultations, in accordance with applicable laws, professional standards in effect in Quebec and the requirements of the relevant professional orders.
Virtual and telemedicine services are offered within a structured framework and may be subject to eligibility criteria, triage protocols, clinical limits and specific conditions applicable to each service or specialty. Clinique Omicron reserves the right, at the sole discretion of the healthcare professional concerned, to refuse, postpone, interrupt or terminate a virtual or telemedicine service if the User's situation requires in-person evaluation, physical examinations, urgent care or if the virtual service is deemed inappropriate.
The User acknowledges that telemedicine services have inherent limitations, notably due to the absence of a physical examination, technological constraints, the quality of the Internet connection or the information provided. Consequently, certain diagnoses, treatments, follow-ups or recommendations may not be possible or appropriate in a virtual setting.
The User agrees to provide complete, accurate, truthful and up-to-date information when using the virtual or telemedicine services. Clinique Omicron and its healthcare professionals cannot be held responsible for any consequences arising from inaccurate, incomplete, misleading or omitted information provided by the User.
Unless otherwise indicated, virtual and telemedicine services may not be covered by public health insurance plans and may be subject to fees, which are communicated to the User prior to the provision of the service. No specific results are guaranteed, and all clinical decisions are the sole responsibility of the healthcare professional's professional judgment.
Use of the virtual and telemedicine services is also governed by Clinique Omicron's Virtual Care Consent Policy, available on the Site, which forms an integral part of these Terms and Conditions and is incorporated herein by reference. By accessing or using the virtual services, the User acknowledges that he or she has read this policy, understands its scope and fully consents to it, including, in particular, the terms of automatic acceptance of consent, the applicable responsibilities and limitations, the complaint management mechanisms, the specific consents per specialty and the planned referral corridors.
Certain features of the Site, including but not limited to scheduling appointments, accessing virtual services, consulting clinical information, managing files or using digital tools, may require the creation of a user account (the «Account»).
The creation and use of an Account is reserved for persons having the legal capacity required to consent to these Terms. The User undertakes to provide accurate, complete, truthful and up-to-date information, and to keep such information up to date at all times. The User remains solely responsible for the accuracy, integrity and updating of the information provided.
The User is responsible for maintaining the confidentiality of his/her login information (username, password or any other authentication mechanism) and any activity carried out through his/her Account. The User agrees to immediately notify Clinique Omicron of any unauthorized use, loss, disclosure or breach of security of the User's login information or Account.
When the User creates an Account or uses the Site, the services or the patient portal on behalf of a third party, a minor or a dependent, he declares that he is legally authorized to do so and assumes full responsibility for the information provided, the consents given and the use of the services on behalf of this person.
Access to the Clinique Omicron patient portal is a separate environment from the Public Site. This portal may be operated, hosted or maintained by a third-party technology service provider. Its use is subject, in addition to these Terms, to the terms, policies and conditions specific to that provider, including authentication, security, data retention and system operation.
Any action performed through the patient portal, including consulting medical information, exchanging messages, transmitting documents, managing appointments or accessing clinical records, is deemed to have been performed by the Authorized User, unless proven otherwise. Clinique Omicron disclaims all liability for service interruptions, technical failures or unavailability of the patient portal attributable to the systems or infrastructure of the third-party supplier, subject to applicable legal obligations.
Clinique Omicron reserves the right, without notice and at its sole discretion, to suspend, restrict or terminate an Account or access to the patient portal, in particular in the event of inaccurate or misleading information, use that does not comply with these Terms, breach of security, risk to the integrity of systems, or when required by law or the competent authorities.
The collection, use, retention and disclosure of personal information by Clinique Omicron are governed by its Privacy Policy, which complies with applicable laws, including the Act respecting the protection of personal information in the private sector (Bill 25). This policy forms an integral part of these Terms and Conditions and is incorporated herein by reference.
Clinique Omicron reserves the right, at its sole discretion and without prior notice, to suspend, limit or terminate the User's access to the Site, any Account, the patient portal or any digital service, in whole or in part, when required to ensure the security, integrity or proper operation of its systems, to prevent abusive, fraudulent or non-compliant use, or in the event of the User's breach of these Terms.
Without limiting the foregoing, such measures may be taken, inter alia, when Clinique Omicron has reasonable grounds to believe that :
- the information provided by the User is false, inaccurate, incomplete, misleading or outdated; ;
- the User makes abusive, inappropriate or illegal use of the Site, patient portal or services; ;
- the security of systems, data, personal information or clinical records is compromised or threatened; ;
- continued access may pose a risk to the clinic, its professionals, other users or third parties; ;
- such action is required by law, a competent authority or as part of an investigation.
The suspension, limitation or termination of access to the Site, Account or patient portal does not terminate, suspend or modify any existing clinical relationship or the professional, ethical or legal obligations applicable to care already undertaken, if any.
Clinique Omicron shall not be liable for any loss, damage, inconvenience or consequence arising from the suspension, limitation or termination of access, subject to mandatory rights under applicable laws, including consumer protection or health services.
The provisions of these Terms which by their nature are intended to survive termination shall remain in force, including but not limited to those relating to limitation of liability, indemnification, intellectual property and applicable law.
The User acknowledges that the use of the Internet, digital technologies and computer systems involves inherent risks, including in particular the risks of service interruption, unauthorized access, loss of data, technical failures or cyber-attacks.
Clinique Omicron implements reasonable administrative, technical and organizational security measures to protect the Site, the patient portal, computer systems and the information processed therein against unauthorized access, misuse, loss, alteration or unauthorized disclosure, in accordance with applicable laws and recognized standards in the healthcare industry.
However, Clinique Omicron cannot guarantee absolute security or ensure that systems, platforms or electronic communications will be free of faults, interruptions, viruses, malicious software or other harmful components. The User acknowledges and accepts that no data transmission over the Internet is completely secure.
The User is responsible for the security of his or her device, Internet connection and login credentials. It is the User's responsibility to maintain adequate security measures, including the use of secure passwords, system updates and protection against malicious software.
To the fullest extent permitted by law, Clinique Omicron disclaims all liability for any damage, direct or indirect, resulting from a breach of computer security, intrusion, loss of data, unauthorized access or technological incident, except in the case of gross negligence or intent on its part or where the law imposes specific liability.
Any security incident involving personal information is managed in accordance with Clinique Omicron's Privacy Policy and applicable legal obligations, including privacy incident management mechanisms provided for by law.
Clinique Omicron attaches the utmost importance to the protection of personal information and undertakes to collect, use, retain, communicate and destroy it in accordance with applicable laws, in particular the Act respecting the protection of personal information in the private sector (RLRQ, c. P-39.1), as amended by Bill 25, as well as other legal, regulatory and professional obligations in force.
In the course of its clinical, administrative and digital activities, Clinique Omicron may collect various types of personal information, including identification information, contact information, administrative information, technological information and health information, when required for the provision of care, the management of clinical files, the use of the Site, the patient portal or virtual services.
Personal information is collected and used only for legitimate and identified purposes, including but not limited to :
- the provision of medical care and health services ;
- management of clinical and administrative files; ;
- appointment scheduling, follow-up and service continuity ;
- communication with the User; ;
- compliance with legal, professional and regulatory obligations; ;
- system security, incident prevention and risk management.
Access to personal information is limited to authorized persons who need it to perform their duties. Clinique Omicron applies appropriate administrative, technical and organizational security measures to ensure the confidentiality, integrity and availability of personal information.
Personal information may be disclosed to third-party service providers, including but not limited to providers of technology solutions, electronic medical record platforms or information technology services, when necessary to provide services. These third parties are bound by contractual obligations of confidentiality and security equivalent to those of Clinique Omicron.
Personal information is retained only as long as necessary for the purposes for which it was collected or in accordance with applicable legal and professional requirements, and then destroyed or made anonymous in a secure manner.
Clinique Omicron's Privacy Policy and Governance of Personal Information, including in particular the Governance policy regarding personal information (PI) held by Clinique Omicron, This Privacy Policy, its appendices, its privacy incident management mechanisms, its complaint handling processes and any subsequent updates, is available on the Site. This Policy forms an integral part of these Terms and Conditions and is incorporated herein by reference.
By accessing the Site, the patient portal or Clinique Omicron's services, the User acknowledges having read this policy, understands its scope and consents to the collection, use, disclosure, retention and destruction of his or her personal information in accordance therewith, subject to the rights provided by law.
In particular, the User has rights of access, rectification and other rights recognized by applicable legislation. Any request relating to personal information may be addressed to Clinique Omicron in accordance with the terms of the Privacy Policy.
Unless otherwise specified, all Content on the Site, the patient portal and any other digital platform operated by Clinique Omicron, including but not limited to text, documents, graphics, images, logos, trademarks, trade names, icons, interfaces, layouts, databases, software, code, video, files, forms and all other elements, is the exclusive property of Clinique Omicron or is subject to valid licenses, and is protected by applicable intellectual property laws, including copyright and trademark laws.
No part of the Site, the Patient Portal or the Content may be copied, reproduced, modified, distributed, broadcast, transmitted, published, displayed, downloaded, exploited or used, in whole or in part, for any commercial or non-commercial purpose, without the prior written consent of Clinique Omicron, except as expressly permitted by law or these Terms.
The User is granted a limited, personal, non-exclusive, non-transferable and revocable license to access the Site and consult the Content for strictly personal and non-commercial purposes, subject to compliance with these Terms. This license does not confer any ownership rights to the Content.
The trademarks, names, logos, visual identities and distinctive signs displayed on the Site or the patient portal, whether registered or not, are the property of Clinique Omicron or authorized third parties and may not be used without express written authorization.
Any unauthorized use of the Content or any intellectual property may violate applicable laws and expose the User to civil or criminal liability, including criminal prosecution.
Intellectual property rights relating to platforms, systems or software provided by third parties remain the property of their respective owners and are governed by their own terms of use.
The Site, the patient portal or other digital platforms operated by Clinique Omicron may contain links or references to websites, platforms, applications, tools or services operated by third parties (the «External Sites»), in particular for informational, administrative, technological or clinical purposes.
These links are provided solely as a convenience to the User and do not constitute an endorsement, recommendation, warranty or representation by Clinique Omicron of the content, accuracy, legality, security, availability or practices of such External Sites.
Clinique Omicron has no control over External Sites, their content, terms of use or confidentiality policies, and declines all responsibility for them. Access to an External Site is the sole responsibility of the User.
Clinique Omicron cannot be held liable for any direct or indirect damage, loss, injury, interruption of service, breach of confidentiality or incident arising from the use of, inability to use or reliance on the content or services offered by an External Site.
When the User leaves the Site or the patient portal to access an external Site, it is the User's responsibility to read and respect the conditions of use, confidentiality policies and practices applicable to that external Site.
The presence of links to external sites does not imply any contractual, clinical, professional or commercial relationship between Clinique Omicron and the operators of these external sites, unless expressly indicated otherwise.
Clinique Omicron maintains a presence on various social media platforms, which may be operated by third-party providers and governed by their own terms of use and privacy policies. By accessing or interacting with Clinique Omicron's social media pages, the User acknowledges that he or she is also bound by the applicable terms and conditions of such third-party providers.
Any content published, transmitted or shared by the User on Clinique Omicron's social media pages, including in particular comments, opinions, messages, images, videos or other contributions, remains the sole responsibility of its author. The User undertakes to publish only content that complies with applicable laws, these Terms, and the rules of civility, respect and confidentiality.
Without limiting the foregoing, it is strictly prohibited to post or disseminate on Clinique Omicron's social media any content :
- false, misleading, defamatory, abusive, threatening or obscene ;
- discriminatory, hateful or inciting to violence ;
- infringe on the privacy, dignity or personal information of others, including patients, healthcare professionals or Clinic staff; ;
- constituting unauthorized advertising, solicitation or promotion; ;
- infringing the intellectual property rights of Clinique Omicron or third parties; ;
- containing personal medical or identifying information.
Clinique Omicron reserves the right, at its sole discretion and without notice, to moderate, hide, delete or refuse any content posted on its social media that it deems inappropriate, non-compliant or contrary to these Terms, without incurring any liability.
By posting content on Clinique Omicron's social media, the User grants Clinique Omicron a non-exclusive, royalty-free, worldwide, irrevocable license to use, reproduce, modify, translate, distribute and display such content for informational, promotional or institutional purposes, without compensation.
Information shared on Clinique Omicron social media does not constitute medical advice, diagnosis, treatment or a patient-healthcare professional relationship. Any questions of a medical nature should be discussed with a qualified healthcare professional.
Clinique Omicron accepts no responsibility for decisions made by the User on the basis of content published on social media, whether originating from the Clinic or from third parties.

The Site, Content, digital tools, forms, interactive features, patient portal and any services accessible through the Site are provided on an «as is» and «as available» basis, without warranty of any kind, either express or implied, to the fullest extent permitted by applicable law.
Without limiting the foregoing, Clinique Omicron does not warrant that :
- the Site or its functionalities will be accessible in a continuous, uninterrupted, secure or error-free manner; ;
- the Site will be compatible with all devices, operating systems, browsers or technological environments; ;
- the information, content or tools made available will be accurate, complete, up-to-date or free of omissions; ;
- access to the Site or digital services will enable you to obtain an appointment, a medical service or clinical care; ;
- the results of using the Site or its services will meet the User's expectations.
Clinique Omicron makes no warranties, express or implied, as to the accuracy, reliability, suitability or completeness of the Content, which may be changed, updated or removed at any time without notice.
The User acknowledges that use of the Site and digital services involves inherent risks, in particular in connection with information technology, electronic communications and data transmission, and that he/she assumes full responsibility therefor.
No information appearing on the Site, no digital exchange and no functionality offered constitutes a guarantee of care, clinical results, diagnoses, treatments or medical follow-up, which are the exclusive responsibility of the professional judgment of healthcare professionals and the terms and conditions applicable to each service.
Legal warranties provided by applicable laws, in particular those which cannot be excluded in matters of consumer protection or health services, remain applicable to the extent required by law.
To the fullest extent permitted by applicable law, Clinique Omicron, its directors, officers, employees, healthcare professionals, agents, partners and service providers shall not be liable for any direct or indirect damages arising out of access to, use of or inability to use the Site.
Without limiting the foregoing, Clinique Omicron shall not be liable for any damages, including but not limited to:
- financial losses, loss of income, loss of profits or loss of opportunities; ;
- material, technological or computer damage; ;
- loss or alteration of data ;
- damages arising from interruptions, delays, technical failures or bugs in the Site, patient portal or digital services; ;
- the consequences of using or relying on Content posted on the Site or on social media; ;
- decisions made by the User on the basis of general information or digital tools accessible on the Site.
Clinique Omicron cannot be held responsible for acts, omissions, clinical decisions, diagnoses, treatments or follow-ups performed by healthcare professionals in the exercise of their professional judgment, whether during face-to-face consultations or telemedicine services, which remain subject to professional standards and applicable laws.
Clinique Omicron also declines all responsibility for :
- services, platforms, software or technological tools provided by third parties; ;
- interruptions or failures related to telecommunication networks or the Internet; ;
- consequences resulting from the User's failure to comply with these Conditions, applicable policies or clinical guidelines.
In all cases, and unless otherwise provided by law, the total liability of Clinique Omicron, all causes combined, is limited to the greater of :
- the sum of one hundred Canadian dollars (100 $), and
- the amount actually paid by the User to Clinique Omicron for the services concerned during the six (6) months preceding the occurrence of the event giving rise to the damage.
Nothing in this section is intended to exclude or limit Clinique Omicron's liability for gross negligence, wilful misconduct or in any situation where such exclusion or limitation is prohibited by applicable law, including health services or consumer protection law.
The User agrees to indemnify, defend and hold harmless Clinique Omicron, and its directors, officers, employees, medical professionals, representatives, agents, partners and service providers, from and against any and all claims, demands, actions, suits, liabilities, damages, losses, costs or expenses, including without limitation reasonable legal fees and expenses, arising directly or indirectly :
- access to or use of the Site, including the patient portal, digital services, forms or interactive features; ;
- the User's failure to comply with these Terms, applicable policies or any applicable law or regulation; ;
- any inaccurate, incomplete, misleading or out-of-date information provided by the User, in particular when making appointments, using virtual services or communicating with the Clinic; ;
- abusive, fraudulent or unauthorized use of the Site, a user account or the services offered; ;
- any infringement of third-party rights, including but not limited to privacy rights, intellectual property rights or confidentiality obligations; ;
- any content, comments, documents or information transmitted, published or shared by the User via the Site or Clinique Omicron's social media.
This indemnification obligation shall survive the termination, suspension or cessation of access to the Site, the patient portal or the services, for any reason whatsoever.
Clinique Omicron reserves the right, at its own expense, to assume the exclusive defense of any claim subject to indemnification under this section, in which event the User agrees to cooperate fully in such defense.
Nothing in this section shall limit or exclude the User's rights under applicable law where such exclusions or limitations are prohibited.
These Terms, as well as any question, claim or dispute arising directly or indirectly from access to the Site, its use, the services offered by Clinique Omicron, including in-person medical care, virtual services, telemedicine, the patient portal and digital tools, shall be governed by and construed in accordance with the laws in force in the Province of Quebec and the federal laws of Canada applicable therein, to the exclusion of any conflict of laws rules.
Subject to the mandatory provisions of applicable law, any dispute, controversy or legal action relating to these Terms, their interpretation, validity, performance or non-performance, shall be subject to the exclusive jurisdiction of the courts of the judicial district where Clinique Omicron's registered office is located, and the User irrevocably acknowledges such jurisdiction and forum.
